Understanding Probate Guardianship and How to Avoid It

At some point in our lives we may end up losing the ability to manage our personal affairs and our own lives. In this case, we must rely on someone else to do these things for us. Guardianship is appointed at this time. A guardian would be needed in a situation where we are not able to prepare meals, take prescribed medication, remember to nourish ourselves, and more. It can become necessary anytime our ability to care for ourselves medically or communicate effectively is lost.

If you are incapacitated without warning and have not appointed a guardian in your estate plan, it's possible the court might have to do it for you. This is called a probate guardianship. Our guardianship attorney in Raleigh is here to further explain this situation.
In order to avoid this situation, it is recommended that you create an estate plan and appoint a guardian for yourself. If you haven’t done this, contact our lawyer. We can help.
There are two types of guardianship. One manages the estate and the other oversees the well-being of an individual who is incapacitated. Most times, the person who is appointed guardianship has both responsibilities. In other cases these responsibilities can be broken into two separate roles.
As we’ve mentioned previously, someone appointed guardian of another must make all the financial and medical decisions for that person. This can include deciding where he or she will live, paying bills, and making decisions regarding medical needs. It is important that the guardian be trustworthy as these are decisions that can affect the livelihood of the individual. However, the court has some supervision over decisions.
If you have not yet appointed a guardian to take care of you in the event that you’re incapacitated without warning, please consider doing so now.
