Problems That May Arise When Naming a Guardian for Your Child, Part Two

Welcome back. Our estate lawyer in Cary NC is here today, to talk further about naming guardians for children within an estate plan. You may assume that your children will be left to grandparents, or another close family member, but that is not always the case. You have the option to make your own decision to ensure the wellbeing and care of your child.

Problems When Naming a Guardian | Estate Lawyer in Cary NC

There are some problems that may arise when you name a guardian for your child, so in this two-part series we will take a look at the factors
If your children have grown up in a household with two parents, and you want the same for them if you and your spouse die, consider naming co-guardians. Even if the pair you choose are married, each person should be named as a co-guardian in your will.
If you have more than one child and are considering naming someone who already his or her own children, take into account whether or not they will be able to handle the added responsibility. If it’s important for your children to stay together, be sure to choose someone who is willing and able to care for all of them. Your will should outline where each child will go. Don’t assume that the court will grant custody of them all to the same person without your specific instructions.
In the next part of this series our estate lawyer in Cary NC will address more things to consider when naming a guardian for your children.
